BY CLICKING "Accept" AND/OR BY USING THE SOFTWARE YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THIS LICENSE AGREEMENT, UNINSTALL THE SOFTWARE AND DO NOT USE IT IN ANY MANNER WHATSOEVER.
Restrictions on Use. You may not: (i) copy, modify, translate, reverse engineer, decompile or disassemble the Software or create derivative works based thereon; (ii) install the Software onto a server so that it is accessible via a public network; (iii) share or permit other individuals/entities to use the Software, rent, lease or transfer the Software or rights to use it; or (iv) delete or modify any attributions, legal notices or other proprietary designations in the Software or part thereof. Any such forbidden use shall immediately and automatically terminate your license to use the Software, without derogating from any other remedies available to RemindCal at law or in equity.
We reserve the right to modify these Terms and Conditions at any time. All changes will be effective immediately upon posting to the website. Your continued use of our services after any changes constitutes your acceptance of the new Terms and Conditions.
Some of your personal data is shared with third party service providers such as:
Google: We use google analytics for tracking user behavior to better improve our system and services
Stripe: We use stripe to process all payments. Information such as credit card information are all processed and stored in stripe. We do not have any access to credit card details.
SendGrid: We use SendGrid to send email notifications. Information such as your name and emails are processed by SendGrid.
We use “cookies” to collect information about you and your activity across our site. A cookie is a small piece of data that our website stores on your computer, and accesses each time you visit, so we can understand how you use our site. This helps us serve you content based on preferences you have specified. Please refer to our Cookie Policy for more information.
You agree not to (a) access the Service in a manner that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of the Service; or (b) use the Service for any illegal or unauthorized purpose.
We reserve the right to terminate or suspend your access to the Service at any time, for any reason, and without notice.
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be available at all times or that it will be error-free.
In no event shall we be liable for any damages arising out of or in connection with the use of the Service.
Your subscription will continue and automatically renew unless canceled. You consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge.
We offer a 14-day free trial to new users. The account will not be charged and the subscription will be suspended until upgraded to a paid version at the end of the free trial. By default all free trials will be registered under the lowest plan package for services available.
You can cancel your subscription at any time by logging into your account. Your cancellation will take effect immediately and access to paid features will be disabled.
We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.
By adding your credit card on file within the portal, you are agreeing to be charged on a monthly recurring basis for platform access and features based on the pricing.
Standard message and data rates may apply to any user sending or receiving SMS, MMS, RCS and other messages.
You must communicate to any recipient of your messages that the recipient can cancel receipt of the messages at any time by texting "STOP" to the originating telephone number or shortcode. When a recipient sends the message "STOP" to us, we will send the recipient a message to confirm that the recipient has been unsubscribed. After this, the recipient will no longer receive messages from us. If a recipient wishes to join again, the recipient must re-sign up as they did the first time and we will start sending messages again. You must conspicuously notify your recipients of these procedures.
SMS/MMS capabilities and features are only for US Based carriers. We do not support sending SMS/MMS outside of the United States. Major US Carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, Alltel, Boost Mobile, and Virgin Mobile.
You agree to adhere to the guidelines of the Cellular Telecommunications Industry Association ("CTIA"), including without limitation "Best Practices" and the "Short Code Monitoring Handbook" currently found at https://www.ctia.org/programs ("CTIA Guidelines").
By providing mobile phone numbers for use on the Service , you represent that:
You are in compliance with the Guidelines
You authorize RemindCals's transmission or delivery of messages to the numbers provided will not violate the Guidelines.
The Services may allow text or SMS communications to Customer, Authorized Users, and other individuals who provide prior written consent. Customer and Authorized Users who provide consent hereby agree to receiving text or SMS messages from RemindCal. By sending text or SMS messages via the Services, Customer and Authorized users represent and warrant that they have obtained consent from the recipient to receive text or SMS messages from Customer, and from Company on Customer's behalf. Recipients are responsible for all taxes, fees and costs associated with receiving text and SMS messages. Recipients may “opt out” of receiving text and SMS messages at any time by revoking consent through Company's text or SMS messaging service (e.g. responding with "STOP"), or by contacting Company directly.
